A new draft regulation for the free flow of non-personal data in the European Union has been published

A new proposal for a regulation of the European Parliament and of the Council on a framework for the free flow of non-personal data in the European Union has been published.

Among the key new elements is the more clearly-defined interrelation between the draft Regulation and Regulation 2016/679 (the General Data Protection Regulation, or GDPR), as according to recital 10 when it comes to mixed sets of personal and non-personal data, the rules, established in GDPR will prevail over those in the draft Regulation.

There is also the curious possibility for Member States to adopt in their domestic law effective, proportionate and dissuasive sanctions against persons who prevent access to data required by competent state authorities for the exercise of their powers (see Article 5 (3) and Recital 19a).
